Application Process 

The Town of Fairfax is accepting applications for commercial cannabis business permits during the open application period. Prospective applicants must follow the structured process outlined below: 

Steps to Apply

  1. Review Requirements: Ensure you meet all eligibility and permit requirements as outlined in the Fairfax Municipal Code and state law. 
  2. Schedule an Appointment: Applications must be submitted by appointment only with the Planning and Building Department.  
    • Appointments Available: Monday – Thursday, 8:30 AM – 12:00 PM and 1:00 PM – 5:00 PM 
    • No drop-ins accepted. 
  3. Complete the Application: Fill out the Cannabis Permit Business Application and include all required documentation. 
  4. Pay Fees and Deposits:  
    • Application Fee: $2,800 
    • Consultant Deposit: $2,000 (An administrative fee of 20% of consultant costs applies if a consultant is used.) 
    • Other Fees: Additional fees may apply for fingerprinting, signage, and compliance reviews. 
  5. Submit Your Application: Bring all required materials and fees to your scheduled appointment. 

Phases

Phase 1: Application Submission & Initial Review 

  • Applicants submit required forms, fees, and permits. 
  • Planning staff will notify applicant if any information is missing or needs correction. 
  • Town Manager makes a final determination on further processing. 

Phase 2: Planning Commission Review & Scoring 

  • Accepted applications are reviewed and scored by the Planning Commission. 
  • Scores are based on the Town’s established evaluation criteria. 

Phase 3: Town Council Final Scoring & Permit Issuance 

  • Applications scoring 80 points or higher (link to Town Approved Scoring Criteria provided below) are forwarded to the Town Council. 
  • The Town Council holds a public hearing and makes final scoring decisions. 
  • Permits are issued to the highest-scoring eligible applicants based on availability. 

Key Dates

  • Application Period Opens: March 18, 2025 
  • Application Deadline: May 22, 2025 

Application Requirements

  • Applicants must provide: 
  • Business and organizational details. 
  • Proof of ownership or authorization from the property owner. 
  • A business plan, including financial capacity and operational procedures. 
  • Security and safety plans. 
  • Proof of compliance with California state licensing. 
  • Traffic and site plans. 
  • Fees and deposits. 

Cost & Fees

  • Application Fee: $2,800 
  • Consultant Deposit: $2,000 
  • Other Fees: Additional fees may apply for fingerprinting, signage, and compliance reviews.
