The owner of the property known as “School Street” located at 95 Broadway has indicated to the Town an interest in developing the property for residential development. As such, this property was included as a potential site for new affordable housing in the Housing Element adopted earlier this year. On November 12, 2024, the Town of Fairfax has received some materials related to a preliminary application for 95 Broadway. Not all of the required application materials were submitted, so it is not considered a valid application at this time. From the materials submitted, it appears that the applicant intends to apply under the Housing Crisis Act of 2019 (SB 330), California Government Code section 65941.1. The applicants were sent a letter on December 2, 2024 requesting the missing information. The applicants are School Street LLC, Alamo, CA (Property Owner); Isaiah Stackhouse, Stackhouse De La Pena Trachtenberg Architect, Berkeley, CA (primary applicant); and Riley Hurd, Ragghianti Freitas LLP, San Rafael, CA (property agent). Once a valid application is submitted the applicant has 180 days to submit a full application.
From what we have received so far it appears that the applicant may be proposing (note that this is subject to change):
- 257,039 square feet of residential with 202 market rate units and 41 affordable units (25% low income affordable)
- 5,750 of commercial space on the ground floor
- Two levels of parking
- Four stories of residential
Under the provisions of California law, the Town is unable to review or comment on the project until a full application is submitted.
Assuming that application is eventually filed, it will be reviewed according to Town requirements. Town Staff will keep the public posted on the progress of this application, including setting up a project page to house documents and information once a valid application is received.
